1. What we grant you

Subject to your compliance with these terms, JAYBE STUDIO grants you a free, worldwide, non-exclusive, non-transferable, revocable license to synchronise and reproduce one or more of the licensed musical works (“the Songs”) supplied with your order, solely in personal, non-commercial video content that you create and own, and solely for the uses listed in the quick view above.

The Songs are original works owned outright by JAYBE STUDIO. The library includes every song written and performed by our founder Jaybe Huang, together with works by other studio artists as they join. JAYBE STUDIO holds the rights necessary to grant this license and retains all rights not expressly granted to you.

• Deliverables: an audio file and a cartoon avatar still, emailed to you.
• Number of songs: one track is included per qualifying order; additional tracks may be purchased at the stated price.
• Studio video production: when JAYBE STUDIO produces a video for you based on your cartoon figure, the copyright music fee is included in the video production price, and this non-commercial license applies to that video.
• No exclusivity: the same Songs may be licensed to other customers. Nothing in this license transfers ownership of the recording or composition.

2. Credit requirement

The license is conditioned on attribution. You must include, in the caption or description of every video that uses a Song, a credit line in substantially this form:

If a platform removes, truncates, or hides the credit, you must restore it or replace it with an equivalent visible credit. A video published without the credit is not covered by this license.

3. What is not permitted

• Any commercial use, including advertising, promotion of a business, client deliverables, sponsored content, affiliate marketing and endorsement.
• Any monetization of the video or the audio, including ad revenue, creator funds, paid memberships, paywalls, or direct sale.
• Uploading the Song, alone or as a primary work, to streaming services, stock libraries, content-ID systems, or music distributors.
• Sampling, remixing, re-recording, altering the melody or lyrics, extracting stems to build new works, or using the Song to train generative models.
• Reproducing, sublicensing, reselling, or transferring the file or these rights to any third party.
• Pairing the Song with footage you do not own, with AI voice-cloning of the artist, or with content that is unlawful, hateful, harassing, defamatory, or politically partisan.

4. Commercial licensing

If you want to use a Song in anything that earns money or promotes a business — a shop, a brand, a channel with revenue, a client project, an ad — you need a separate written commercial license. Because JAYBE STUDIO owns the catalogue outright, we can usually price this quickly and simply:

5. Term, territory & revocation

• Term: the license runs for as long as your use remains personal and non-commercial.
• Territory: worldwide.
• Revocation: the license terminates automatically if you breach these terms. On termination you must stop distributing and, where reasonably possible, remove the content.
• Survival of credit: videos published lawfully before termination may remain online provided they keep the credit line and are not monetized.

6. Ownership & copyright

All Songs, including their composition, lyrics, performance and master recording, are and remain the property of JAYBE STUDIO and/or their credited writers and performers, including founder Jaybe Huang. This license grants a limited right to use; it does not assign, sell, or transfer any copyright interest. You may not register the Song, or any derivative of it, with any content-identification system or rights organisation.

7. Third-party claims & platform disputes

Because JAYBE STUDIO owns the compositions and masters, there is no third party with standing to claim your video's audio for our Songs. Should a platform misidentify or mute your audio, contact us with the link and we will help resolve it, or provide a different track. We do not issue claims against customer videos that follow these terms.

8. Fair use & statutory rights

Nothing in these terms limits any rights you may have under applicable law, including exceptions and limitations to copyright such as fair use or fair dealing.

9. Liability & governing terms

The Songs are provided “as is”, without warranties of any kind. To the maximum extent permitted by law, JAYBE STUDIO's total liability arising from your use of the Songs will not exceed the amount you paid for the order that included them. These terms are governed by the laws applicable at our place of business, without regard to conflict-of-law rules, and supersede any marketing description of the music program.

10. License FAQ

Is the song really free?

Yes, for personal and non-commercial posting. One track is included with each qualifying order; extra tracks cost the stated price and go to the artist.

Can I use it on my monetized channel?

No — that is commercial use. Request a commercial license and we will quote a small flat fee.

Can I use the song for someone else's keepsake?

Yes, if it is a gift you paid for and the video stays personal and non-commercial. No, if you are making content for a brand or a client.

Where do I get the credit line?

The Caption & Credit Kit has ready-to-copy versions for TikTok, YouTube and Instagram.
