1. What these terms cover
These terms apply to everything you buy from Jaybe Studio (details in section 12), whether it is a
custom piece made from your photo — a figurine, keychain or display item — a Jaybe merch item made
from our own artwork and likeness, or a digital film or song. By placing an order you accept them. If you
do not accept them, please do not order.
2. Orders & acceptance
• Your order is an offer to buy. A contract is formed when we accept it — normally the email confirming your
order, or the design proof for a custom piece.
• We may decline an order, and refund you in full, if we cannot make it (for example the photo is unusable), if
the content is unlawful or infringing (section 5), or if there is an obvious pricing error.
• The options you choose at checkout — Form (Big Head, MV Dress, Half Body), Size, add-ons and
quantity — become part of the order and of the price.
3. Pricing & payment
• Prices are shown in US dollars (USD) and include the design work, printing, finishing and hand sealing
for the piece you ordered. They do not include import duties or taxes set by your own country (see
Shipping & Delivery).
• Where a "compare at" price is shown, it is the price the piece is normally sold at and the sale price is the
price you pay. The higher figure is never the price you pay.
• Payment is handled by Shopify and its payment providers (card networks, PayPal, Klarna and similar).
We never receive or store your card number.
• Where a multi-item code is offered (for example SAVE5 / SAVE10 / SAVE15), it applies to that order only and
cannot be combined with another code.
4. Made-to-order products
Custom pieces are made for you alone, from your photo:
• The approved proof defines the piece. We email a proof, you revise it as often as you like (free and
unlimited) and production begins when you approve it. What you approve is what we make.
• It is a sculpt, not a photograph. Our artists model the face, hair, build, outfit and pose by hand.
A strong, well-lit photo gives the strongest likeness.
• Material characteristics. Pieces are printed layer by layer in full-colour UV-cured resin and sealed by
hand. Small differences in tone and fine surface marks are normal features of the process, not faults.
• Sizes are approximate. Heights stated in centimetres are measured head to feet and are subject to the
usual tolerance of a hand-finished piece.
• Not toys. Pieces contain small parts and are not suitable for children under three.
• Guarantee, cancellations and refunds are set out in Returns &
Refunds.
5. Your photo, your promise
When you send us a photo you confirm that:
• The photo is yours to use, or you have the permission of whoever owns it.
• You have permission from every person who appears in it to have a figurine made — and, if a child
appears, you are their parent or guardian.
• It does not contain anyone else's protected work or likeness — for example a celebrity photo, a film still, a
sports club badge, a cartoon or game character, or a logo you do not own. We will decline these.
• It is not unlawful, hateful, sexual, or intended to harass or defame anyone.
You keep ownership of your photo. You give us a limited licence to use it only to make and support your
order — nothing else. See the Privacy Policy for how long we
keep it. If you break this section, you are responsible for any claim that results, and we may cancel the order
and refund any amount not yet spent on production.
6. Jaybe merch & official-likeness items
Stickers, prints, the sticker sheets and the official Jaybe figurine are made from our own artwork and
Jaybe's own likeness. They are not custom: there is no photo upload, no design proof, and the face is not
changed to match a customer. Designs for these items — including the Big Head, MV Dress and Half Body forms of
the official figurine — are ours.
7. Digital films & the song
• Video Plus films are delivered by email or download link, usually within 2–4 days, in the format you
chose (9:16, 16:9 or both).
• Every order also unlocks one licensed original song from our own catalogue.
• The included music licence is personal and non-commercial: use it on your own social accounts, keep the
credit line we give you. Advertising, sponsored posts, client work and monetised channels are not covered — ask
us for a commercial quote instead. Full terms: Music License.
• Digital items are personal to you. You may not resell them or pass them off as your own work.
8. Intellectual property
Ours: the Jaybe Studio name and logo, our figurine designs and forms, our photographs and illustrations,
the store's text and images, and all songs and recordings in our catalogue — which belong to Jaybe Huang and
Jaybe Studio. You may not copy, resell or use them commercially without our written permission.
Yours: your own photo stays yours. We claim no rights over it beyond what we need to make your order.
Photos of our own work: if you post a picture of a piece we made, we may ask to feature it. We will only
do so with your permission, and we will credit you.
9. Acceptable use
Do not use the store to upload, order or request anything unlawful, hateful, sexual, violent, or that infringes
someone else's rights or likeness. Do not attempt to disrupt the store, scrape it, copy its content, or use it in
a way that harms other customers. We may refuse or cancel an order that breaks this section.
10. Disclaimers & liability
• We do the work with professional care and stand behind it with the 180-day remake guarantee. Beyond that, the
store and its content are provided as they are.
• We are not liable for indirect or consequential losses — for example a missed event, lost opportunity, or
emotional distress — to the extent the law allows us to exclude them.
• Where we are liable, our total liability for an order is limited to the amount you paid for that
order.
• Nothing here limits rights you have that cannot be excluded by law, including your statutory consumer
rights.
11. Governing law & changes
These terms are governed by the laws of the People's Republic of China, and the courts of Shenzhen have
jurisdiction over any dispute — without taking away any mandatory consumer protection you have where you live.
We may update these terms; the version that applies to your order is the one published when you placed it, and
the date at the top of this page always shows the latest revision.
